Ziggy's Cycle & Sport Ltd. ("Ziggy's," "we," "us," or "our") respects your privacy. This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you visit ziggyscycle.ca, shop with us online or in store, create an account, request service or support, join a promotion or event, subscribe to communications, or otherwise interact with us (collectively, the "Services").

Our online store is hosted by Shopify. Depending on how you use Shopify features such as Shop or Shop Pay, Shopify may also process personal information under its own privacy notice.

1. Accountability

Ziggy's is responsible for personal information under its control. Our Privacy Officer oversees our privacy practices and can be contacted using the information at the end of this policy.

2. Personal Information We Collect

The information we collect depends on how you interact with us and may include:

  • Contact and identity information, such as your name, email address, telephone number, billing address, shipping address, and account identifiers;
  • Transaction information, such as products and services purchased, order value, payment status, delivery method, returns, store credit, warranty information, and purchase history;
  • Payment information, such as payment method, billing details, and payment confirmation. Complete card details are generally collected and processed by our payment providers rather than stored directly by us;
  • Shopping and account information, such as items viewed, cart activity, wish lists, account preferences, and saved settings;
  • Service and bicycle information, such as bicycle make, model, serial number, measurements, fit or service details, work requested, and service history where relevant;
  • Communications, such as messages, calls, reviews, survey responses, contest entries, event registrations, warranty requests, and customer-support records;
  • Device and usage information, such as IP address, browser and device type, operating system, pages viewed, referring page, session activity, cookie identifiers, approximate location derived from IP address, and security or fraud signals; and
  • Information from other sources, such as Shopify, payment processors, fraud-prevention providers, shipping carriers, manufacturers, distributors, marketing platforms, analytics providers, and social media services, where permitted by law.

Please do not provide personal information we do not need, including sensitive health or financial information, through ordinary email, reviews, or open text fields.

3. How We Use Personal Information

We may use personal information to:

  • process payments and fulfill, ship, deliver, or make orders available for pickup;
  • create and manage accounts, wish lists, store credit, gift cards, returns, exchanges, warranties, and service records;
  • provide bicycle assembly, fitting, repair, maintenance, product support, and customer service;

  • measure website and marketing performance and understand how customers use our Services;

We obtain consent where required and in a form appropriate to the sensitivity of the information and the circumstances. You may withdraw consent for optional uses at any time, subject to legal or contractual restrictions and reasonable notice. Withdrawal does not affect prior lawful processing. It may limit our ability to provide a feature or service that depends on the information.

We send commercial electronic messages only with the consent or other legal authority required by Canada's anti-spam law. Our marketing messages identify the sender and include an unsubscribe method. You can also ask us to stop by contacting info@ziggyscycle.ca.

After you unsubscribe, we may retain limited information needed to respect your preference. You may still receive non-promotional communications about an order, account, service appointment, warranty, product recall, or safety matter.

We and our service providers may use cookies, pixels, local storage, and similar technologies to operate the website, remember preferences, keep your cart and account working, protect against fraud, measure performance, understand traffic, and support marketing where permitted.

7. How We Disclose Personal Information

  • service providers that support ecommerce hosting, payment processing, fraud prevention, order fulfillment, delivery, cloud storage, customer service, email, analytics, advertising, IT, security, and professional advice;
  • manufacturers and distributors where needed to fulfill a special order, register or administer a warranty, address a recall, or provide technical support;
  • business and marketing partners for optional promotions, analytics, or advertising where permitted and subject to applicable consent choices;
  • law enforcement, regulators, courts, insurers, or other parties where permitted or required by law, or where reasonably necessary to protect rights, safety, property, or the integrity of our Services;

8. Shopify and Third-Party Services

Shopify processes information to provide and improve the commerce platform and, for some features, may act independently from Ziggy's. You can learn more in Shopify's Consumer Privacy Policy and use available controls at Shopify's Privacy Portal.

Our website may link to third-party websites or include third-party tools. Their privacy practices are governed by their own notices. We encourage you to review them before providing information.

9. Processing Outside Canada

Some service providers may process or store personal information outside Ontario or Canada, including in the United States and other jurisdictions. While information is in another jurisdiction, it may be subject to that jurisdiction's laws and may be accessible to courts, law enforcement, or national security authorities there. We remain responsible for personal information transferred to service providers acting on our behalf and use contractual or other safeguards appropriate to the circumstances.

10. Retention

We retain personal information only as long as reasonably necessary for the purposes described in this policy, including to provide Services, maintain warranty and service records, meet tax and accounting obligations, resolve disputes, enforce agreements, manage safety or recall matters, and comply with law. Retention periods vary by record type. When information is no longer required, we securely delete, destroy, or anonymize it, subject to permitted backups and legal holds.

We use administrative, technical, and physical safeguards appropriate to the sensitivity of the information, which may include access controls, staff practices, encryption in transit, secure service providers, monitoring, and incident-response procedures. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

You are responsible for protecting your account password and for notifying us promptly if you believe your account or personal information has been compromised.

12. Your Privacy Rights

Subject to applicable law and limited exceptions, you may request:

  • access to personal information we hold about you and information about how it has been used or disclosed;
  • correction of inaccurate or incomplete personal information;

To make a request, contact our Privacy Officer. We may need to verify your identity and clarify the request. We will respond within the time required by law. If we cannot fulfill all or part of a request, we will explain why, subject to legal restrictions.

13. Children's Privacy

Our website is intended for a general audience and purchases must be made by a person who has reached the age of majority or with the involvement and consent of a parent or legal guardian. We do not knowingly collect personal information directly from children under 13 without parent or guardian consent. If you believe a child has provided personal information without appropriate consent, contact us so we can review and address it.

14. Changes to This Policy

We may update this Privacy Policy to reflect changes to our practices, technology, service providers, or legal obligations. We will post the revised policy and update the date above. Where required, we will provide additional notice or obtain consent for a material new use or disclosure.
