These Terms of Service ("Terms") govern your access to and use of ziggyscycle.ca, including purchases made through the website. The website and store are operated by Ziggy's Cycle & Sport Ltd. ("Ziggy's," "we," "us," or "our"). Our online store is hosted by Shopify.

By using the website, creating an account, or placing an order, you agree to these Terms and to the policies linked or referred to in them. If you do not agree, do not use the website. Nothing in these Terms limits a right or remedy that applicable law does not allow us to limit.

1. Eligibility and Accounts

You must be at least the age of majority where you live to make a purchase, or place an order with the involvement and consent of a parent or legal guardian.

You are responsible for providing accurate, current, and complete account and order information, protecting your login credentials, and promptly notifying us of suspected unauthorized use. We may suspend or close an account where reasonably necessary to protect customers, the website, or our business, or where these Terms have been materially violated.

2. Permitted Use

You may use the website only for lawful personal or commercial shopping purposes consistent with these Terms. You must not:

use the website or its content for an unlawful, fraudulent, abusive, or misleading purpose;
interfere with the website, introduce malicious code, test vulnerabilities without authorization, or bypass security or access controls;
scrape, harvest, or collect data or personal information by automated means except as permitted by law and our written authorization;
impersonate another person or provide false account, payment, or order information;
infringe intellectual property, privacy, publicity, or other legal rights; or
use the website in a way that unreasonably burdens or disrupts it or another user's experience.

3. Products, Services, and Cycling Safety

Product descriptions, sizing information, compatibility information, photographs, and other website content are provided to help with purchase decisions. We make reasonable efforts to keep them accurate, but manufacturer specifications can change and display settings can affect appearance.

Choosing, installing, maintaining, and using bicycles and cycling products involves judgment and can involve risk. Follow manufacturer instructions and warnings, use suitable safety equipment, inspect equipment before use, and obtain qualified assistance where appropriate. Website content is general information and is not a substitute for an in-person bicycle assessment, professional fitting, installation, repair, or safety inspection.

4. Orders and Contract Formation

Submitting an order is an offer to purchase under these Terms and the information presented at checkout. An automated order confirmation acknowledges receipt; it does not necessarily confirm that inventory, payment, shipping eligibility, or the order has been accepted.

We may accept, decline, limit, or cancel an order before fulfillment for a lawful reason, including unavailable inventory, payment or fraud concerns, manufacturer restrictions, shipping limitations, suspected resale activity, or a material pricing or product-information error. If we do not accept an order after payment has been captured, we will refund the cancelled amount to the original payment method.

5. Prices, Taxes, and Payment

Unless stated otherwise, prices are in Canadian dollars. Applicable taxes and shipping or delivery charges are disclosed before you submit an order. We may change prices prospectively without notice, but a change will not alter an order we have already accepted except with your agreement or as permitted by law.

You authorize us and our payment service providers to process the charges associated with an order using the payment method you select. You represent that you are authorized to use that payment method.

If we discover a material price, discount, shipping-charge, or product-information error before accepting or fulfilling an order, we may correct it and ask whether you wish to proceed or cancel the affected item. We will not substitute a higher price or additional mandatory fee without disclosure and your agreement.

6. Promotions, Gift Cards, and Store Credit

Promotions are subject to their stated terms, dates, eligibility, exclusions, and available quantities. Unless expressly stated, promotions cannot be combined or applied retroactively.

Gift cards and store credit are subject to applicable law and any terms disclosed when issued. They are not redeemable for cash except where required by law. Protect gift card and store-credit information as you would cash, and contact us promptly if you suspect unauthorized use.

7. Shipping, Pickup, Returns, and Warranties

Manufacturer or distributor warranties may apply to certain products. Any warranty described on a product page or supplied with a product is subject to its own terms. A manufacturer warranty is in addition to, and does not replace, any statutory right that applies to your purchase.

8. Intellectual Property

The website and its original text, graphics, logos, photographs, layout, software, and other content are owned by or licensed to Ziggy's and are protected by applicable intellectual property laws. Product names, trademarks, photographs, and other manufacturer content belong to their respective owners.

You may view and use the website for your own lawful shopping and informational purposes. No other licence is granted. You must not reproduce, modify, distribute, sell, or commercially exploit protected website content without the rights holder's prior permission, except as permitted by law.

9. Reviews, Feedback, and Other Submissions

If you submit a review, photograph, comment, or other content, you retain ownership of your content and grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, format, and use it for operating and promoting Ziggy's, subject to our Privacy Policy and applicable law. This licence ends if the content is removed from our services, except for uses already lawfully made or required for records and legal compliance.

You represent that you have the right to submit the content and that it is accurate, lawful, and does not infringe another person's rights. We may moderate or remove content that violates these Terms, but we are not required to monitor all submissions. Nothing in these Terms prevents you from making an honest review or complaint.

10. Third-Party Services and Links

The website may use or link to third-party services, including Shopify, payment providers, map providers, social media, product manufacturers, and shipping carriers. Third-party services are governed by their own terms and privacy practices. We are not responsible for third-party content or services we do not control, but this does not limit any responsibility we have for service providers acting on our behalf.

11. Privacy and Electronic Messages

Our collection, use, and disclosure of personal information are described in our Privacy Policy. Promotional electronic messages are sent only where we have the consent or other legal authority required by Canada's anti-spam law. You can unsubscribe using the link in a marketing email or by contacting us. You may still receive non-promotional messages about your account, order, warranty, safety, or service request.

12. Website Availability and Disclaimers

We aim to keep the website available, secure, and accurate, but we do not guarantee uninterrupted or error-free access. We may maintain, change, suspend, or discontinue website features from time to time.

To the maximum extent permitted by law, the website and general website content are provided on an "as available" basis. We do not exclude or limit any express warranty we make, any applicable manufacturer warranty, or any condition, warranty, right, or remedy that cannot lawfully be excluded or limited.

13. Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for our fraud, wilful misconduct, gross negligence, or breach of a non-excludable statutory right.

Subject to the previous paragraph and to the maximum extent permitted by law, Ziggy's is not liable for indirect, incidental, special, punitive, or consequential loss arising solely from use of, or inability to use, the website. This website limitation does not remove remedies that may apply to products or services you purchase from us.

14. Indemnity for Unlawful Misuse

To the extent permitted by law, you are responsible for reasonable losses, claims, and costs that a third party incurs because of your unlawful misuse of the website, your infringement of that third party's rights, or content you submit in violation of these Terms. This section does not apply to ordinary consumer use of products purchased from us.

15. Governing Law

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario. The courts of Ontario have jurisdiction, except where applicable consumer law gives you the right to bring a proceeding in another jurisdiction or prohibits this choice of law or forum.

16. Changes to These Terms

We may update these Terms to reflect changes to our website, practices, or legal obligations. The updated Terms will be posted with a revised "Last updated" date. Material changes apply prospectively unless applicable law permits or requires otherwise. The Terms in effect when we accept an order continue to govern that order unless you agree to a change or the law requires it.

17. General

If any provision of these Terms is found unenforceable, the remaining provisions continue to apply. Our failure to enforce a provision is not a waiver of it. Headings are for convenience only.
